FX COMPETITION TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THIS COMPETITION.

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

  • These terms and conditions together with any specific rules set out in Competition Notices (as defined below) are the competition Terms (“Terms”) together defined as the “Competition”, unless otherwise expressly stated. By entering a Competition entrants agree to be bound by these Terms.
  • Terms specific to this competition are displayed in FX Magazine and the Promoters website web page posting for such competition (the “Competition Notice”) and are incorporated here. In the event of discrepancy between these terms and conditions and the Competition Notice these terms shall prevail.
  • We reserve the right to cancel or amend the Competition, the Competition Notice or these terms. A copy of the Terms may also be obtained by sending a stamped self-addressed envelope addressed “Competition Terms” to the Promoter.

THE PROMOTER

  • The promoter is: Brintons Carpets Limited, Wyre Forest House, Fine Point Way, Kidderminster, Worcestershire, DY11 7WF

THE PRIZE

  • The first prize is £500 and a woven sample of their design in addition to the cash prize, second prize £200 and the third prize £100.
  • In the event of the prize not being available for whatever reason, the Promoter may offer an alternative prize of equal or greater value and quality.
  • Any and all prize related expenses, including without limitation any and all national and/or local taxes shall be the sole responsibility of the winner.
  • The prize is as stated with no cash alternative in whole or in part and is non-transferable.

ENTRIES

  • The competition will run for a limited time only, opening on 2nd January and closing Midnight 30th September 2020. Entries received after the closing date will not be entered.
  • To enter this competition, you must visit brintons.net and complete the online competition entry form. No other form of entry is accepted.
  • Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Brintons.
  • Maximum one entry per user. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Brintons.
  • The Promoter will not accept responsibility for lost competition entries, including, for example, as a result of Internet malfunction.
  • By entering this competition, you are agreeing to be bound by these terms and conditions.
  • Entries maybe be shared on social media, and the Brinton’s website. With approx. 20 words about each designer/design inspiration.
  • The design must be a new and exclusive design created by the entrant for this competition.
  • The design must not have been manufactured commercially before.
  • This competition is open to individuals only, you must work alone and not as part of a team in creating the design.

ELIGIBILITY

  • To be eligible to participate in this competition you must be a resident in - England, Wales, Scotland, Isle of Man or Channel Islands] and aged 18 years or over at the date of entry.
  • Employees of Brintons, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate.
  • No third party entries, bulk entries or entries submitted by agents will be accepted.
  • By entering the competition, you hereby warrant that all information submitted by you is true, current and complete.
  • We assume that by using our site and entering the Competition (and you warrant that) you have legal capacity to enter the Competition and agree to the Terms (i.e that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) of your entry of the Competition and use of these Terms.
  • We reserve the right to disqualify any entrant if we have reasonable grounds to believe the entrant has significantly breached any of these terms and conditions. In the event that any entrant is disqualified from the Competition, in our sole discretion we may decide whether a replacement contestant should be selected. In this event, any further entrant will be selected on the same criteria as the original entract and will be subject to these Terms.
  • In the event of any dispute regarding results, and all other matters relating to a Competition, our decision will be final and no correspondence or discussion will be entered into.

WINNERS

  • All final submissions to be judged by Theresa Dowling from FX and Emma Cassidy from Brintons. The judges’ decision is final, there is no other alternative to the prize stated and the prize is not transferable, and no part or parts of the prize may be submitted for others.
  • The winner will be announced by the 19th October 2020.
  • The winner will be notified via the contact details supplied.
  • The Promoter will make all reasonable efforts to contact the winner. Winners will be notified within 7 days following the winner selection.
  • Brintons shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information.
  • If the selected winner cannot be contacted, is ineligible or fails to claim the prize within 7 days from the time award notification was sent, prize may be forfeited and an alternate winner selected.
  • We reserve the right, in our absolute discretion , to request a proof of identity in the form of your passport, driving licence and/or a utility bill bearing your address.
  • Delivery of cash prize will be within 14 days of the winner being announced and carpet sample to follow within 6 weeks.

DATA PROTECTION

  • If you are the winner of the competition, the Promoter may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable related promotional purposes.
  • Any personal data relating to competition entrants will be used in accordance with the Promoter’s privacy policy which can be found at brintons.net/privacy and will not subject to the above, be disclosed to a third party without the individuals prior consent.

LIMITATION OF LIABILITY

  • By entering you agree to release and hold harmless Brintons and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly.
  • This includes, whether caused by negligence or not, from entrant's participation in the competition and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

INTELLECTUAL PROPERTY RIGHTS

  • You hereby grant and assign to Brintons Carpets Ltd., the entire copyright and other intellectual property rights in and/or arising from your entry and your involvement in the Competition (including, without limitation all interviews, pictures, audio, audiovisual , whether your appearance is featured or incidental) in all media and technology (the “Products”, and where such products are not in existence at the date of this Agreement by way or present assignment or future assignment.
  • You represent and warrant that you have the right, power and authority to grant the rights set out above and you have obtained all consents and permissions in respect of the same.
  • For the avoidance of doubt, all rights in the name and title of the Competition and the format rights for the Competition will vest exclusively in Brintons Carpets Ltd., for its own use (in its absolute discretion).
  • In consideration of us agreeing to consider entrants to this competition, each entrant hereby assigns to us the complete copyright and all other rights in any entry, which shall be for the full period of copyright. We shall be free to assign such rights to third parties.
  • You hereby warrant that the information that you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything, which is libellous, defamatory, obscene, indecent, harassing or threatening and shall indemnify Brintons Carpets Ltd for any loss, damage or liability arising in connection therewith. If relevant, we reserve the right , but not the obligations (and without limiting our rights under your warranty and indemnity above), to screen, filter and/or monitor information provided by your and edit, refuse to distribute or remove the same.

GENERAL

  • The Promoter reserves the right to suspend or cancel the competition where it becomes necessary to do so for reasons outside of the Promoter’s reasonable control.
  • All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
  • In the event that any provision of these terms are held to be illegal, invalid, void or otherwise enforceable it shall be severed from the remaining provisions of the terms which will continue in full force and effect.
  • The failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies.
  • These terms are not intended to nor shall create any rights, entitlements, claims or benefits enforceable by any person that is not a party to them. Accordingly no person shall derive any benefit or have any right, entitlement or claim in relation to the Agreement by virtue of the Contracts (Right of Third Parties) Act 1999.

JURISDICTION

  • The Competition and the terms and conditions of this agreement will be governed by English law and the parties irrevocably submit to the exclusive jurisdiction of the English Courts.
